Roommate Ratted Out iPhone 4G Thief, Finders Tried to Destroy Evidence

Vandalism and sale of trade secrets are two of the top charges that may be leveled against Gizmodo's staff

Gizmodo/Gawker employees Brian Lam and Jason Chen are embroiled in a mess over the fourth generation iPhone that they purchased and then tore apart. Lam and Chen contend that the iPhone was merely lost and that they are innocent. Apple, however reported the phone stolen.

Documents concerning the case and the search of Chen's house have been released in the form of an affidavit pertaining to the search of Chen's home. The damning summary of the case comes on page 12, which reads:

Suspect Brian Hogan found or stole a prototype iPhone 4G that was accidentally left at a restaurant by Apple employee Robert "Gray" Powell. Hogan identified the owner of the phone as Apple Engineer Gray Powell through the contents of the phone and through Internet searches. Rather than return the prototype phone to Powell and/or Apple, Hogan subsequently sold the iPhone Jason Chen in Fremont for $5000. Upon receiving the stolen property, Chen disassembled the iPhone, thereby causing it to be damaged. Chen created copies of the iPhone prototype in the form of digital images and video, which were subsequently published on the Internet based magazine Gizmodo.com.

It's will be mighty hard for Gizmodo to dispute that, except perhaps for the phone's status being stolen. However, Apple had reported the lost phone prototype stolen before Gizmodo found it.

New iPhone, New iPhone OS, Cheaper $99 iPhone, Steve Jobs is Back...


Apple's WWDC 2009 liveblog is just a weekend away. On the menu: Definitely Snow Leopard, new iPhone, new iPhone OS, and maybe even a guest star appearance of Steve Jobs himself. Here are the latest updates:

The new iPhone

The biggest announcement and biggest question mark is the new version of the iPhone. A new model is coming for sure, but we don't know what will be in it.

Most probably, the new Apple cell will keep its current design. Since Steve Jobs came to Apple, dramatic industrial design changes have only happened across various generations of gut changes. Historically, the iMac, the Powerbook/Macbook, or the Mac Pro went through several iterations before experiencing a complete redesign. It's too early for the iPhone to change its face dramatically, specially when the current form factor works so well. And, after all, there are only a few ways to do a touch-screen phone. The iPhone 3G's design is simple, elegant, and works extremely well, so there is no reason to see a big re-design now.

Some people are talking about multiple color versions. With the iPod mini, nano, and shuffle, color became a way to convert the low-end hardware into fashion accessories. The iMac also went through that phase, which was later abandoned. The iPod, however, always stayed either white or black, becoming an icon on its own right. The iPhone is also a higher-end icon. Down the line—maybe in a different incarnation, as the iPhone OS product family expands—color will appear. But for now, looking at Apple's past history, logic dictates that the iPhone won't see the variety of colors that the iPod nano has now.

Other rumors point at something called "the unibody iPhone", which is a retarded notion at best. The iPhone is already "unibody." It may not be carved out of a single piece of aluminum, but there's no need for that. It is a single surface—which is made of plastic to make reception better—and a glass top. It doesn't get any simpler than that.

What we know today:

• Like I said above, we knew that the new iPhone was coming already, but Walter Mossberg—who is well known for having a very tight relation with Apple—strongly suggested that the new hardware is a sure shot next week. He did it in his Palm Pre review, potentially offsetting the Pre's current advantages with unrevealed incoming features in the iPhone.

• The Financial Times, BGR, and Engadget also say their sources claim that $99 iPhones are on the pipeline.

• There may be sightly different components in the design, as shown in the pages of a Chinese original components wholesaler.

• The new iPhone may also experience a change of materials, going from shiny to matte.

Why We Still Need the iPhone App Black Market

A year ago, we said that no iPhone SDK meant no killer apps. It came, and the apps are here in staggering numbers. But many of the amazing apps and concepts we grew to love as unofficial apps aren't here, and only about 100 of the 500+ apps at launch in the official store are really useful or desirable—the rest are dupes or just bad. There are no less than five apps to turn my iPhone into a flashlight, yet I can't turn it into a 3G-powered Wi-Fi hotspot. Why? Because the SDK has more restrictions than Guantanamo—devs can't integrate with the OS and have to steer way, way clear of copyright and trademark issues—so the most innovative, game-changing apps might not ever make it to your squeaky clean iPhone. That's why we need more than Apple's official app store—we still need jailbreaking, Installer.app (now Cydia) and the best unauthorized third-party apps to make the iPhone an ultra-powerful open platform we really want.

Huge iPhone Security Flaw Opens All Private Information

There's a huge security problem in the latest iPhone 2.0.2: if you have your JesusPhone password protected, using a very simple trick gives anyone full access to your cellphone private information in Mail, SMS, Contacts, and even Safari. The two-step trick is even simpler to the one used in the past to gain access to the phone to install unlocking cards or jailbreak. Fortunately, there's a way to avoid this obvious security breach until Apple fixes it.

First, password protect your phone and lock it. Then slide to unlock and do this:

1. Tap emergency call.
2. Double tap the home button.

Done. You are now in your favorites. This seems like a feature, because you may want to have emergency number in your favorites for quick dial. The security problem here is double. The first: anyone picking up your phone can make a call to anyone in your favorites. On top of that, this also opens access to your full Address Book, the dial keypad, and your voice mail.

Lightning Review: iPhone Tetris App

The App: Tetris with excellent touch implementation. In a matter of seconds anyone will be comfortably rotating, placing and flicking blocks around the screen, and the block placement preview is a welcome addition.

The Price: $9.99

The Verdict: Tetris isn't exactly the most ambitious project for a company like EA Games. That's probably why the company's iPhone port is just, well, overdone. A good Tetris implementation - one that would have been wildly successful on its own - wasn't enough for EA, who've loaded this port up with so much crap that it sometimes doesn't even run. EA obviously wanted to use a bit of the iPhone's rendering capabilities, but the graphics are gaudy to the point of distraction. Starting or resuming a basic game takes quite a while because of the layers of menus and loading screens, and the secondary gameplay modes and Magic Mode tools will be ignored by most. On our 3G iPhone, the app would often freeze at startup, a problem that has been reported elsewhere among iPhone and iPod owners. An update is forthcoming that should address stability issues as well as introduce a feature that allows you to draw your upcoming shape directly.

These inspired features, though, are sullied by the showy, buggy execution. Anyone looking for a simple, clean port like Tris (from the jailbreak days. See you soon, Tris...) should probably pass on this $9.99 monster as you can expect a decent competitor to pop up at a lower price point, if not for free. Also, there are already web apps that offer a traditional (though gestureless) Tetris experience in your browser that don't have a 40 second startup time. One more sticky point: if you exit out of the game to check email or take a call and return, it will save your game state. But to start playing again you have to sit through 10 seconds of the intro movie. Freaking annoying and a waste of battery.

Gizmodo says Don't buy an iPhone

An iPhone software update has wiped out non-Apple apps, which has upset the gadget freaks.

This week's Apple iPhone update may have bricked a few hacked phones, but this is the least important part of the problem. What probably upset many more early adopters was the way Apple wiped out their applications, reducing their phones to the "official" software. This sent out a very clear message: The iPhone is for dummies. It's not for gadget freaks, who only represent a tiny minority of the market.

The Gizmodo gadget blog has therefore changed its iPhone recommendation to Don't Buy. It says:

Screw the unlock for a second. Let's talk about the those third-party apps. While my 4GB iPhone is a brick, and the 8GB phone, which I kept on a totally legit AT&T contract, is now stripped down. Programs like the faux-GPS, IM clients, Flickr Upload, and NES emulator -- what did they ever do but make the iPhone far better than the stock original? They made it far more competitive with open-platform superphones like the Nokia N95, to which I will now be switching.

As someone remarks in a comment to the post, Gizmodo has gone from "Jesus Christ himself owned one of these (prove he didn't)" to "It's crap, don't buy it" in the time it took to update firmware.

How to: 8 Ways to Get Ringtones Onto Your iPhone For Free

Purchasable iPhone Ringtones are officially here. However, with the discovery of free iPhone ringtones from inside iTunes 7.4 (and the rediscovery of them in iTunes 7.4.1), most of you won't want to pay $0.99 for the privilege of using a 30-second version of a song you've already purchased. Here are eight alternative ways to get ringtones onto your iPhone.

Options that require Jailbreak

• SSH/File Transfer: All you have to do is drop an iPhone's iPod-compatible ringtone into the /Library/Ringtones directory, meaning you can use MP3s, AACs (protected and unprotected), or M4As. Anything that your iPhone's iPod supports will work.
• iBrickr (Windows): iBrickr actually transcodes your sound files for you, so if you're looking up old WAV sound pages from 1999, iBrickr can convert them into something that the iPhone understands before syncing. [iBrickr]
• iFuntastic (Mac): Same as the SSH/File Transfer option. Just drag them into the correct /Library/Ringtones folder. [iFuntastic]
• Sendsong: Allows you to pick any song from your iPod and move it into the Ringtones section. Install this with AppTapp.

Options that don't require Jailbreak

• iTunes Music Store: You can manually place AAC files into the correct iTunes Ringtones folder as long as it has the right file extension. Works with purchased iTunes songs or songs you've converted to AAC format. [JoeMaller]
• Rogue Ameoba's MakeiPhoneRingtone (Mac): This takes advantage of the iTunes 7.4 and iTunes 7.4.1 ringtone file compatibility workaround to get the Ringtones show up in iTunes. All you have to do is drop in an AAC file, which can be one of your songs purchased from iTunes. [MakeiPhoneRingtone]
• iToner (Mac): Copies ringtones to your iPhone, bypassing iTunes, should be guaranteed to work with future iPhone updates. Costs $15. [iToner]
• iPhoneRingToneMaker (Windows): Transfers ringtones to your iPhone, but lets you edit them beforehand in its editor so you can chop down long songs to a manageable clip. [efksoft]

We recommend you use one of the free methods, since they're actually quite easy to do. Even if you don't want to jailbreak your phone, the iTunes Music Store manual method and Rogue Amoeba's MakeiPhoneRingtone can take care of this for free. But if you want to make sure your ringtones don't get deleted when a new version of iTunes or iPhone Firmware comes out, you may want to try jailbreaking and placing the songs into the ringtones folder manually.
