Apple Sued Over iPhone Bricking

"The week's debate over the iPhone 1.1.1 has finally resulted in legal action. InfoWeek reports that on Friday, California resident Timothy Smith sued Apple in a class-action case in Santa Clara County Superior court. The suit was filed by Damian Fernandez, the lawyer who's been soliciting plaintiffs all week for a case against Apple. The suit doesn't ask for a specific dollar amount, but seeks an injunction against Apple, which prevents it from sell the iPhone with any software lock. It also asks that Apple be enjoined from denying warranty service to users of unlocked iPhone, and from requiring iPhone users to get their phone service through AT&T."

theodp writes "Slate takes a look at the alarming lesson of the iPhone price cut and ponders the long-term effects of a Fire-Sale Nation mentality, especially when companies go all Crazy Eddie slashing prices on products like homes and cars that have active secondary markets. 'High-profile price-chopping tends to occur whenever companies freak out about the vicious combination of a slowing consumer economy and the prospect of getting stuck with big inventories of unsold goods. The tactic often works in the short term. The hype over insanely low prices functions as a form of free advertising, and the lower prices tend to attract buyers. Apple announced on Sept. 10 that it had sold its 1 millionth iPhone.'"

Can Apple + AT&T Shut Down iPhone Unlockers?

aalobode writes "Do Apple and AT&T have the legal right to stop hackers from selling unlocked iPhones? Under their terms, only AT&T may sell iPhones, and Apple gets a commission. When unlocked iPhones are used on other providers' networks, AT&T and hence Apple get nothing beyond what they earned on the initial sale of the hardware. Can they prohibit unlocking? Reselling? The article in Businessweek gives the for and against arguments, but leans toward the view that the hackers may have the law on their side for once."

Microsoft CEO Claims iPhone Will Be Bust

"In an interview with USA Today, Microsoft CEO Steve Ballmer claimed there is no chance that the iPhone is going to get any significant market share. The article also deals with Microsoft's friction with the Justice Department, friction with Google, and the profitability of MSN. 'No chance. It's a $500 subsidized item. They may make a lot of money. But if you actually take a look at the 1.3 billion phones that get sold, I'd prefer to have our software in 60% or 70% or 80% of them, than I would to have 2% or 3%, which is what Apple might get. In the case of music, Apple got out early. They were the first to really recognize that you couldn't just think about the device and all the pieces separately. Bravo. Credit that to Steve (Jobs) and Apple. They did a nice job. But it's not like we're at the end of the line of innovation that's going to come in the way people listen to music, watch videos, etc. I'll bet our ads will be less edgy. But my 85-year-old uncle probably will never own an iPod, and I hope we'll get him to own a Zune.'"

What Do You Want In iPhone 2.0?

"The predictions about the iPhone being a bust have so far been way off the mark, but that doesn't mean the device is perfect. Besides the dependence on the AT&T Edge network and the lack of an iPhone SDK, there are a boatload of UI, software and hardware issues that should be addressed in the next-generation iPhone. Some complaints include GPS functionality, allowing iPhones to be used as hard drives, adding RSS support, and turning auto-correct into auto-complete.
